StreamifyUs Terms of Service

Effective Date: June 14th, 2025.

These Terms of Service ("Terms") govern your access to and use of the services, software, and websites (collectively, the “Services”) provided by StreamifyUs LLC (“StreamifyUs,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms.

1. Overview of Services

StreamifyUs is a review automation platform that enables businesses to request, collect, and manage customer reviews across platforms such as Google and Yelp. Our services include, but are not limited to:

• Automated review request flows 

• QR code generation for review collection

• Filtering negative reviews for internal feedback

• SMS and email outreach

• CRM integrations

• Dashboard access via Lead Connector App

• Manual onboarding support

Future features may include Google My Business missed-call text back and additional automation tools.

2. Eligibility & Account Creation

To use our Services, you must:

• Be at least 18 years old and able to enter into legally binding contracts.

• Provide accurate and complete registration information.

• Be authorized to represent your business.

We create user accounts on your behalf. Access is granted through the Lead Connector app, where you may change your password and manage your profile.

3. Subscriptions, Billing, and Refunds

3.1 Subscription Terms

StreamifyUs offers monthly, 3-month (quarterly), and 6-month subscription plans. By subscribing, you agree to commit to the selected term and will be billed via Stripe. 

If you purchase services from StreamifyUs, you agree to pay the associate fees. Payment terms and billing information will be outlined in your purchase agreement. We reserve the right to change our pricing and billing methods upon notice to you.

3.2 Cancellations and Refunds

Monthly Plans: Non-refundable.Multi-Month Plans: You may pause your plan or cancel early and receive a refund for unused, pre-paid months.Demo Access: We provide a free text message demo on our homepage to preview how our service works.

4. Data Collection and Privacy

By using StreamifyUs, you authorize us to collect and process:

• Personal information (e.g., name, phone number, email)

• Business details (e.g., address, EIN, business name)

• Contact lists you upload or send to us for campaigns

We process and send SMS and email communications on your behalf. All data collection and use are governed by our Privacy Policy.

5. Acceptable Use

You agree not to:

• Use the Services for illegal or misleading marketing campaigns.

• Send unsolicited messages that violate SMS or email marketing laws (e.g., TCPA, CAN-SPAM).

• Upload data you do not have permission to use.

• Impersonate others or misrepresent your affiliation.

• Interfere with or disrupt the functionality of the platform.

6. Third-Party Integrations

StreamifyUs integrates with third-party platforms such as Google, Facebook, Yelp, and others available through Go High Level. You are solely responsible for maintaining access to and complying with the terms of these third-party services.

7. Termination

We reserve the right to suspend or terminate your access to the Services at our discretion, including but not limited to:

• Violations of these Terms

• Fraudulent, abusive, or harmful activity

• Non-payment or chargebacksMisuse of our platform or integrations

You may terminate your subscription at any time. Only multi-month subscribers are eligible for pro-rated refunds of unused months.

We may suspend or terminate your access to our services at our sole discretion for any reason, including but not limited to violation of these Terms and Conditions, disruptive behavior, or any activities that may harm other users or our services.

8. Service Availability and Limitations

We use third-party platforms to host and deliver our Services. While we aim for high availability, we do not guarantee uninterrupted service and are not liable for third-party outages or technical issues.

9. Limitation of Liability

To the fullest extent permitted by law, StreamifyUs is not liable for:

• Any indirect, incidental, or consequential damages

• Lost business, revenue, or data

• Errors in SMS/email delivery or customer response rates

• Business decisions made based on the Services or data

Our total liability under these Terms is limited to the amount you paid in the six months preceding the claim.

10. Modifications to Terms

We may update these Terms from time to time. When we do, we’ll notify you via email or in-app message. Continued use of the Services constitutes your acceptance of the revised Terms.

12. Dispute Resolution & Arbitration

12.1 Informal Resolution First

Before formally pursuing a dispute, you agree to first contact us at [email protected] and attempt to resolve the issue informally. Most concerns can be resolved quickly and to your satisfaction without formal legal action.

12.2 Binding Arbitration

If we are unable to resolve a dispute informally within 90 days, both you and StreamifyUs agree to resolve any claims, disputes, or controversies (excluding claims for injunctive or other equitable relief) through final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

• Location: Arbitration will be conducted in Los Angeles County, California, unless both parties agree otherwise.

• Arbitrator Authority: The arbitrator will have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this agreement.

• Individual Basis Only: You agree to resolve disputes with us only on an individual basis and not as a plaintiff or class member in any purported class or representative action.

12.3 Exceptions

Notwithstanding the above:

• Either party may seek equitable relief (e.g., injunction) for the alleged misuse or unauthorized use of intellectual property.

• You or StreamifyUs may also bring claims in small claims court in Los Angeles County, CA, if the claims qualify under that court’s rules.

12.4 Governing Law

These Terms and any dispute arising under them are governed by the laws of the State of California, without regard to its conflict of laws principles.
